Bylaws and Declaration
History

    The Bylaws and Declaration were voted on and passed in September 2011. All Homeowners should have the new copy of the By-Laws and Declaration. If you need another copy for some reason you can contact the Board and one will be made for you for a fee.

  • Articles of incorporation - Nov 5, 1979
  • Amended Bylaws (in effect) - dated March 22, 2012
  • Amended Declaration (in effect) - dated March 22, 2012

Notice
According to the Orchard Hill Association, Inc., the Declaration article 20 states that the existing by-laws be amended by February 2010 (or they are renewed without changes until they are ammended).   A special committee has reviewed the by-laws and covenants, and suggested some changes.  A lawyer was hired and he has reviewed the covenants. The lawyer provided them to the board for first review in November.  A copy was distributed by mail to all owners for review in May 2010, comments and approval (by consent form and at meeting [6/28/2010).  The bylaws/covenants are in effect until the new covenants-bylaws are approved by the owners.
 
Update (2/1/12)
            The Bylaws and Declaration were voted on and passed in September 2011. They are now at the Lawyers for final grammar corrections and processing. Look for your final copy to be mailed to you, these will be the ones you keep!
 
Update (8/6/10)
The board has asked that all homeowners submit their concerns and questions to the Bylaw Review Committee by 8/27/10.  We have provided a format that requests specific information about any issue you would like us to clearify.  You may download that form here.  This may be e-mailed to the board or mailed to our Post Office Box.  Once we have a complete list of concerns, the Bylaw Review Committee and board will carefully review each concern with our lawyer before taking any further action.

Update (5/29/10)
The covenants composed of two documents Bylaws and Declaration were mailed in mid May and should have being received by all.  To be approved 50% of the members should be in favor (See extra of bylaws/covenantsDownload or search the "Bylaws-covenants-corrected(org).pdf" file below).  Bring your two consent forms (blue and purple) at the Annual Meeting (June 28). Consent forms for the documents are:  Bylaws (consent form on blue paper in mailing or  Download ) and Declaration (consent form on purple paper in mailing  or  Download). If the Covenants are not approved by June 28 meeting, the board will schedule another meeting (added cost and work for your volunteer-board).

Update (5/1/10)
The board received the final version of the covenants from the lawyers. They are being prepared to be mailed to each of you and you can expect them by Mid May. Please review and return your Consent forms (in the mailing) by June 21, 2010.

Update (11/1/09)
We should get the documents soon. It is expected that the board will review them in December (lawyer will revise them as need in January) and they would be distributed to owner for a March meeting.

Update (8/24/09)
The lawyer told us that when we signed the contract, there were 7 Communities ahead of us.  He's currently on the 4th one now, so there are still 2 ahead of us.  He believes we will have it in Sept/Oct., depending on trials and other work that comes in, as he's the only one who takes care of Community amendments/bylaws etc. in his office.

Update (4/17/09)
The board received the documents in late October 2009, they were discussed at the board meeting of December, the Lawyer came to the January meeting to discuss the changes and advice the board, in February the board took into consideration the information provide and in March the lawyer amended the documents. The board review them again and now they are back into the Lawyer hands to be finalized. We should get them by the end of April to be then copied and mailed to each owner for review and vote.
